Duke Kunshan University Sport Complex Assumption of Risk, Waiver and Release from Liability
In consideration of the use of the property, facilities and/or services provided to me by Duke Kunshan University (
DKU ) through the Department of Athletics, the member, individually or as parent or guardian of a minor, agrees as follows:
RISK FACTORS: The member understands and acknowledges that the use of equipment, facilities and/or services provided by the Department of Athletics at DKU and participation in recreation programs and activities (intramural, informal, instructional, group fitness, physical sports, weight and cardiovascular training, swimming and any other programs and services sponsored by the Department and/or activities occurring in recreation facilities) involves risk, including but not limited to the following: risk of property damage or loss, bodily injury, disability, and possibly death. These risks may result from the use of the equipment or facilities, from the activity itself, from the acts or omissions of others, organization of an activity, or from the unavailability of immediate emergency medical care.ASSUMPTION OF RISK: Except for any injuries caused by gross negligence or wilful or wanton misconduct of any employees or representatives of DKU, the member assumes all risks involved with or arising out of the use of the equipment or facilities, the activity itself, the acts or omissions of others, organization of an activity, or the unavailability of immediate emergency medical care, including but not limited to those risk factors as described above.ACKNOWLEDGEMENT OF POLICIES AND RULES: The member agrees to comply with all policies and rules posted in the facilities and/or provided by the Department.PREREQUISITE SKILLS: The member acknowledges that he or she has the requisite skills, qualifications, physical ability, and training necessary to properly and safely use the equipment and facilities, and to participate in the activity itself. The member accepts full responsibility for determining their own health, medical, physical, mental, or other conditions, qualifications, or suitability for participating in the activities. The member agrees that if he or she has any questions as to what skills, qualifications or training is necessary to properly use equipment, the facility, or participate in the activity itself, then he or she shall direct such questions to the appropriate Department staff member onsite.WAIVER AND RELEASE OF LIABILITY: The member releases, waives, discharges, covenant not to sue, and agrees to indemnify and hold harmless for any and all purposes (i) DKU, its affiliates, trustees, Chancellor, Executive Vice Chancellor, Vice Chancellors, officers, employees, or agents, and (ii) offices, departments, schools, programs, centers, divisions, clubs, and any other organizations or units of DKU and their members, officers, employees, faculty, staff, students, volunteers, servants, associates, contractors, or agents ("Releasees or Indemnitees") from and against any and all liabilities, claims, demands, and causes of action arising out of or related to any loss, damage, injury (including death), or harm of any sort, including without limitation court costs and attorney’s fees and expenses that may be sustained by me, and loss or damage to any property belonging to me, which occur as a result of my participation in the activities, or as a result of any emergency evacuation facilitated by the organizers of the activities, or as a result of any medical care/treatment received in connection with participation in the activities. My express intent and consent in signing this Waiver is that the terms of this Waiver shall bind any person asserting rights on my behalf, or any person otherwise asserting claims by or through me, including a spouse, domestic partner, family members, heirs, assigns, and personal representatives. It is also my express intent and consent to not only release any and all claims against Releasees, but also to relieve Releasees from any liability to make contribution to other tortfeasors on account of any claims.The member agrees to pay for any and all damages to any property or indemnitee caused by the negligent, willful or wanton misconduct of the member.
The member enters into this agreement for him/herself, his/her heirs, assigns, and legal representatives.
CONSENT FOR EMERGENCY TREATMENT: The member, as a participant in an activity or user of the facilities, hereby consents to medical treatment in a medical emergency if the member is unable to consent to such treatment.The member acknowledges and understands that DKU strongly recommends being covered by appropriate health and accident insurance for participation in activities, and it is the member’s sole responsibility to procure and maintain such appropriate health and accident insurance at their own cost.

Waiver and Release of Liability
In consideration of the use of the equipment, facilities, and/or services provided to my child/children by Duke Kunshan University (“
DKU ”) through the Department of Athletics (the “
Department ”), I, the undersigned parent or guardian, agree on behalf of my child/children to be bound by this Duke Kunshan University Faculty and Staff’s Children’s Sports Complex Membership Waiver (this “
Waiver ”):

PREREQUISITE SKILLS: I acknowledge that my child/children have the requisite skills, qualifications, physical and mental capacities, and trainings necessary to properly and safely use the equipment and facilities and to participate in the activity itself. I accept full responsibility for determining my child/children's health, including medical, physical, mental, or other conditions and qualifications, or suitability for participating in the activities. I agree that if I have any questions about what skills, qualifications, or training are necessary to properly use equipment, the facility, or participate in the activity itself, I will direct such questions to the appropriate Department staff member on site before my child/children’s use of equipment, facilities, and/or services provided by DKU.

GENERAL FACILITY USAGE RULES AND POLICIES
Use facilities and equipment at your own risk.
Personal items should not be placed on the floor, beside windows, on workout machines or in other areas where these items may be disruptive to other members. All personal items must be stored in the lockers or cubbies provided.
Return workout or sport equipment to its rightful place after use.
Appropriate clothing must be worn at all times.
All structured group activities must be scheduled through DKU Athletics.
Non-athletic shoes and all shoes with black soles are not allowed on sport surfaces.
Use headphones when listening to music.
Do not remove any workout equipment from its designated area.
Persons under 18 are not permitted to use the gym unless they are registered DKU students with a signed waiver from a parent or legal guardian.
All users must abide by all posted regulations, signage, and directions provided by the program management.
Report any faulty or broken equipment to Sports Complex staff and do not use.
Any individuals who violate access policies may be removed from the facility immediately, their membership terminated, and be reported to DKU Conduct office. This includes, but is not limited to, opening a facility door to allow other individuals access, using another individual’s ID card, purposefully damaging facilities, and intentionally breaking facility usage rules.
Disruptive behavior will not be tolerated. Members may be asked to leave and have gym access suspended.
Facilities will secure their doors 15 minutes prior to closing; individuals will be allowed to leave by the closing hour.
Only authorized staff can adjust the temperature, lights, or other facility settings.
Food and snacks are not allowed in workout or sports spaces. All drinks must be carried in non-glass containers with a lid.
The use of skateboards, roller blades, bikes, or other conveyances and vehicles is not permitted in the Sports Complex.
